There is nothing wrong with the Solicitor General "having to agree" -- and nothing dumb about saying that -- because the legal issue used by the government to challenge the constitutionality of the law is Federal preemption; whether there is racial profiling or not has no logical place in preemption analysis.

For the same reason it was equally stupid for Rosenthal to find Roberts' disinterest in the racial profiling issue remarkable or indicative of his opinion about the constitutionality of the law.urban legendnoreply@blogger.comtag:blogger.com,1999:blog-8611810694571930415.post-73625382847633908912012-04-26T19:18:42.848-04:002012-04-26T19:18:42.848-04:00To possess a towering intellect such as Bob's,...To possess a towering intellect such as Bob's, and to be forced to live among mere mediocre mortals, must be an unbearable burden.Confusednoreply@blogger.comtag:blogger.com,1999:blog-8611810694571930415.post-49064095097781473792012-04-26T18:06:03.904-04:002012-04-26T18:06:03.904-04:00What a well-reasoned and sensible rebuttal!

He could say that although federal law says that all illegal immigrants should be deported, he disapproves of such a policy. He could say that he disapproves of the AZ law, because it would result in greater enforcement of immigration law, but the Times is opposed to greater enforcement. We all know that's what he means. It would be nice if he just said it.David in Calnoreply@blogger.com
