TUESDAY, OCTOBER 27, 2026
As we all know, the answer is yes: On Saturday, October 17, we closed our report with remarks which have been described, by at least one site, as a "record shattering statement."
We were describing the way we Americans might be able to find our way out of our current journalistic / political / academic mess. It's considered bad form to quote oneself. Today, we make an exception:
We Americans can't fact-check or name-call our way out of our current national mess—"back out of all this now too much for us," as Frost confusingly had it.
Instead, we'll need to emerge into a world of deepened American values—some of them seeming to be a bit Reddish, some of them tilting toward Blue.
If we want to emerge from our current (dangerous) mess, we'll need to concentrate on values. And some of the values on which we settle may tend to come a bit more from what is currently the reddish end of the pile.
We thought of that "record shattering" suggestion as we perused Elie Honig's recent piece for New York magazine. Honig is a senior legal analyst for CNN. He's also a regular contributor to New York.
Honig's essay concerns the ongoing pursuit of Rp. Ilhan Omar by the current DOJ. The headline seems to tilt in a Blue direction. Under current circumstances, the opening grafs may perhaps seem to tilt Red:
DoJ’s Ilhan Omar Probe Reeks of Politics
Last week’s search of Ilhan Omar’s home was abnormal in several key respects, and she’ll have an opportunity to contest the government’s actions if she does find herself on the wrong end of an indictment. But the truth is, at this point, anyone who definitively proclaims Omar’s guilt or non-guilt is just guessing. Let’s start with what we do and don’t know.
We do know that federal prosecutors obtained approval from a federal magistrate judge, Matthew Sharbaugh, to search Omar’s home. (Magistrates are appointed by district court judges—not by the president—and can exercise certain administrative judicial powers, including review and approval of search warrants.) That means prosecutors convinced the magistrate judge that probable cause that a federal crime was committed exists and that investigators would find evidence of that crime in the place to be searched. We also know that prosecutors have issued at least a dozen subpoenas, which do not require any judicial review or approval. We don’t know, however, precisely what evidence prosecutors marshaled to convince the judge to sign off or how strong the current case is against Omar or others.
Say what? Anyone who "definitively proclaims Omar’s...non-guilt" would just be guessing at this point? Is Honig allowed to say that?
Clearly, he's allowed to say it, but does it make any sense? After all these years of rumor-peddling on grimy MAGA programs like Gutfeld!, is it possible that Rep. Omar has actually done something wrong? Something for which she could (reasonably) be criminally charged? Something for which she could lose her citizenship?
Honig, who isn't a MAGA adherent, says the answer is yes/ (Meaning yes, it's possible.) He also says it's possible that the answer will turn out to be no.
(Concerning that magistrate judge, the Wall Street Journal's James Freeman has reported that "when he was a lawyer in private practice, Mr. Sharbaugh donated to various Democratic political campaigns, including those of Hillary Clinton and Joe Biden." So there's also that.)
Honig runs through various possibilities, dismissing certain procedural objections which have been raised against a possible prosecution. As he closes, his headline comes into play—the recent announcement seems baldly political, he now seems to say:
[W]e know that Trump and his allies would delight in an Omar prosecution, regardless of the strength of the evidence. The president has used grotesque, inflammatory language to attack Omar’s ethnicity, race, national origin, and family, often calling for her to “go back” to Somalia, as he has continued to do after the search. The appearance of a sitting president’s pliant DoJ investigating one of his nemeses in this way is disturbing...
Then there’s the question of timing. Federal authorities searched Omar’s home just 22 days before a midterm election in which the incumbent Democratic U.S. representative from Minnesota is on the ballot. That timing ordinarily would violate the Justice Department’s traditional practice—sometimes referenced colloquially as the “60-day rule”–of refraining from overt law enforcement actions (like executing a search warrant, which is plainly visible to the public) during the run-up to an election. There’s no binding law here. But the DoJ has imposed the prohibition on itself, for decades and under both political parties, to prevent prosecutors from influencing an election, or even appearing to do so.
The timing here looks grimy, Honig says. That doesn't mean that there might not be some violation of law, he says once again as his essay closes:
The problem here isn’t necessarily the investigation of Omar itself; it’s the timing of the search warrant on the brink of an election. Omar might be guilty of some crime, or perhaps not. We’ll find out, eventually. Either way, the Justice Department has done institutional damage to itself, yet again, by letting politics drive its prosecutorial tactics.
Has Rep. Omar done something wrong? Honig says he doesn't know; we ourselves have no idea.
More generally, is it possible that one of us Blues did something wrong at some point in time? Everything is possible, including even that!
As a nation, are we ever going to pull ourselves out of our dangerous downward spiral? If so, Blues and Reds will have to agree on an obvious point:
Sometimes, people make mistakes (or not). But are we ready to say, as tribal beings, that people we favor on our own side can sometimes, just maybe, be wrong?
In our view, the timing of the DOJ's announcement is just flatly wrong. Has Rep. Omar ever done anything wrong? Here at this site, we hope not.
ReplyDelete"DoJ’s Ilhan Omar Probe Reeks of Politics"
Sure. Any probe of any retarded Dumbocrat Reeks of Politics ©.
And every prosecution of any opponent of retarded Dumbocrats is The Affirmation of the Supremacy of Law. Because No One is Above The Law.
We all know that, no need to remind us, Bob.
Boring, tedious, repetitious, and offensive. OK, we can live with that. But brain-dead?
DeleteThe trolls are fighting amongst themselves.
DeleteAnd the namecalling Anons, as usual, are sniping from their hiding places.
DeleteWell, this is a brain-dead blog, George.
DeleteWell, I'll accept your concession that this blog fails to stimulate your brain.
DeleteThe trolls are sniping.
DeleteYikes!
My brain is beyond stimulation. Even vintage pornography leaves me cold.
DeleteTroll Wars.
DeleteGrab some popcorn!
Has anybody been able to detect any signs of brain activity in namecallers?
DeleteOr are they just programed to repeat: "You're a troll, you're a troll, you're a troll!" incessantly?
DeleteBut they’re right, I am a troll.
DeleteIf DG weren't a troll, he would be discussing something else. He convicts himself of trollish behavior by the content of his comments.
DeleteThe only reason Somerby has never stated there is a Republican voter who isn't a bigot, is because there isn't an iota of proof there is one.
DeleteIf some proof there is a Republican voter who isn't a bigot finally/ eventually comes along, he might change his mind.
Somerby suggests that blues need to acquiesce to red values if we want to get out of current dangerous mess.
ReplyDeleteThis is a common right wing/Republican talking point that would result in our mess only getting worse, which is why this kind of message no longer has any play. Dems no longer have any interest in coddling Republicans, like they tried out for the past several decades. It was a colossal failure, the Dem neoliberal Third Way experiment.
Somerby then goes on to explain that Omar might be innocent but gives several reasons why the charges might be valid, while offering nothing about the possibility that she is innocent other than he hopes she did not do anything wrong.
This is the same Somerby that finger-wagged at Dems for addressing Trump's crimes. Fight it out through debates and elections, he said back then. What a hypocrite.
Trump has been accused of numerous crimes and the target of numerous investigations that were later halted, including many sexual assaults, even against minors.
Has Trump ever done anything wrong? I hope not.
The fact remains, we don’t know if Ilhan did anything wrong.
DeleteThe fact remains, the sky generally appears blue.
DeleteOTOH, Trump is a convicted felon.
Omar has committed the crime of making Republicans look bad. All while being non White and a Muslim, for Christ's sake.
DeleteSo as far as Trump and the Republicans (and Somerby) are concerned, Omar is a major crime boss.
OTOH - Trump is currently paying millions to a woman he raped.
DeleteAt this point only a moron can't see that Somerby is a Dem-hating right winger.
DeleteBob never said Ilhan is a crime boss.
Delete4:29 - The Haters like to make shit up about Somerby. Go figure.
DeleteAnonymouse 4:06pm, no, moron. Morons are the morons who buy your moronic garage.
DeleteI did not have a garage sale, moron.
DeleteAnonymouse 5:12pm, exactly, No one is buying.
DeleteNo one can afford to buy in this Trump economy.
Delete"Somerby then goes on to explain that Omar might be innocent but gives several reasons why the charges might be valid"
DeleteWhat a garbled mess of a comment. Somerby doesn't give any reasons why the charges might be valid; he merely quotes Honig. And Somerby explicitly says he has no idea whether Omar is guilty or not.
He has no idea? Bless his little heart.
DeleteGuilty of what, 6:41?? She hasn’t been charged with anything.
DeleteFuck off trannysoros troll.
DeleteLooks like Somerby got all the whining about Gutfeld being bad for Republican branding out of his system in his earlier post.
ReplyDeleteThen he went on to suggest that we offer up Omar as a sacrifice to the Republican gods.
Somerby is such a weirdo.
He did not suggest any such thing.
DeleteAgree with 3:38, he did suggest that.
DeleteHe may be a weirdo but he is more of an asshole.
What Somerby said is that he doesn't know if Omar is innocent, and he hopes that she is.
DeleteYou also don't know whether she is innocent, and you hope that she is.
The only difference is that you pretend to know that she is innocent -- but you don't.
Bob is a weirdo asshole, but he didn’t suggest we sacrifice Ilhan.
DeleteSomerby doesn't know if Omar is innocent, but he says he hopes so.
DeleteOn the other hand, everyone knows Republican voters are bigots, even those who hope not.
Republican —> magat —> bigot —> deplorable
DeleteNo Dog, we think trumps abuse and weaponizing the DOJ exceeds by orders of magnitude anything Ihlan might possibly have done when she was 12, you shameless slug.
DeleteWe agree that Trump's crimes are much worse than anything Omar might have done. But that, of course, is irrelevant to the issue whether Somerby offered up Omar as a sacrifice. And the fact that you''ve been reduced to namecalling means -- I win!
DeleteFuck off, dog . Innocent?
DeleteWith this DO”J”, the presumption should be that the charges are false.
DeleteShe has not been charged with anything.
Delete5:21 - Presume away. I, for one, presume that this investigation is a DOJ witch hunt -- why else would the DOJ ignore the 60-days-before-an-election policy?
DeleteBut, still, we just don't know, do we? And it is true that a magistrate judge, who seems to be a Democrat, looked at evidence that we haven't seen and concluded there was sufficient probable cause of the commission of a crime to authorize a search warrant.
More than 93% of search warrants are approved on their very first submission, according to AI.
Delete5:57 - Good point, but my guess (and it's a guess!) is that a magistrate judge would be particularly careful about authorizing a search warrant for the home of a sitting member of Congress.
Deletelol 😂
DeleteDG,
Delete"a magistrate judge...looked at evidence that we haven't seen"
This perhaps should be written as 'evidence' we haven't seen since this evidence was provided by the Trump DOJ.
Trump's accusations tend to be bogus.
DeleteHector -- I could not agree more. Look at all the no bills, the latest being Cassidy Hutchinson.
DeleteWow, I hadn't heard that about Hutchinson. What a bunch of clowns.
DeleteA ham sandwich would have a fighting chance against these Trumpian bozos.
DeleteThey indicted comey a third time yesterday, without going to a grand jury. Maybe he did something wrong. Anything’s possible.
DeleteKeep in mind that when the fucking media refers to the fucking DOJ, the fucking media really is referring to fucking Trump’s fucking lawyer
DeleteExactly. Time to seriously start talking about the fucking fascists, and actual Nazi supporting Elon dumping $750B into the elections, the startling progress of Project 2025, Americans murdered by the state without repercussions for the murderers, taking a giant dump on Ukraine, and so on. Fuck this shit.
DeleteCecelia has not been charged with any crime, as far as we know.
ReplyDeleteAnd we’re keeping it that way.
DeleteYes but per Somerby and DG, we can’t say Cecelia is innocent either.🙂
DeleteSomerby and DG are correct. We don't know that Cecelia is innocent. Of course we have no reason to think she's guilty, either.
DeleteFor myself, I just imagine her as pure, sweet, innocent.
I imagine Cecilia as chatty and feisty.
DeleteMaybe Somerby and DG should dig up Ken Starr to get to the bottom of the Omar crime spree
DeleteDefine innocent…
DeleteInnocent is the Protestant version of a nice Catholic girl.
DeleteFuck off Cecelia.
DeleteGrand Jury refuses to indict Cassidy Hutchinson. Jabba the Trump threw a ketchup bottle at the wall
ReplyDelete“According to the Washington Post, officials during the first Trump administration requested a review of Omar's immigration records and family background for potential fraud. Career immigration staffers and subsequent reviews found no citizenship issues or sufficient evidence of wrongdoing, and no charges were filed.”
ReplyDeleteBut is it possible she did something wrong? We Blues. So tribal.
Somerby at the very least has a snarky tone, implying that we “blues” tribally defend our “stars”, even though it’s possible she did “something” wrong.
ReplyDeleteRemind me not to ask Somerby for help defending against vindictive prosecutions as we slide into authoritarianism and the DOJ has become a lawless outfit.
When you’re vindictively prosecuted, it helps if you’re innocent in fact.
DeleteHas Omar been charged with anything?
Delete“If a court determines that a prosecution is truly vindictive, the appropriate legal remedy is the dismissal of the tainted or retaliatory charges. This dismissal addresses the constitutional violation directly, even if evidence shows you could have otherwise been convicted.”
DeleteSuck on it.
When you’re vindictively prosecuted the courts should take the license from the vindictive prosecutor and throw him s vindictive ass in jail.
DeleteMaybe David Hearn really did something wrong.
ReplyDeleteWe all know that Omar's crimes are (1) being a Democrat, (2) being an immigrant, (3) being from Somalia, a country that Trump has been persecuting, (4) being female, (5) being Muslim and wearing a headscarf, (6) being an effective legislator, (7) being visible politically, (8) having a high likelihood of being reelected.
ReplyDeleteIn fact, Omar is exactly the kind of scrappy kid who doesn't back down from a fight that Somerby has been calling for. Look what that gets you, in Trump's administration. She needs to be defended in her innocence, not surrounded by so-called blue voters who shrug and say the courts will figure it out. This is political persecution and Trump is guilty, very obviously, because there is a pattern of such vindictive prosecutions. There is no point in suggesting Omar may be innocent (implying she may also be guilty) when Trump is so provably guilty in his pursuit of these politically motivated "lawfare". Somerby pretends he has never heard of that concept even though it is right before his nose.
This is a miscarriage of justice and we blues must defend our elected officials, not try to distance ourselves from them, as Somerby suggests. There is a higher value in keeping politics unbiased and fair, than in being always right about someone's guilt or innocence before there has been any trial or presentation of evidence.
I am so glad I don't know Somerby personally. If I did, I might have to throw a pumpkin at his house on Halloween. He is illustrating everything wrong with our politics -- a man who is obviously right wing, pretending that we Democrats are doing it all wrong when we defend our elected representatives from political crap like Omar is receiving. The Republicans no doubt want to discourage other liberals from running for office by setting an example of the crap that can be thrown at you by criminals like Trump. It takes someone with Acton's and Omar's grit to do it.
Bravo 👏
DeleteFunny, @8:18, those are the same reasons why I believe she will NOT go to jail, even if she committed crimes. Our justice system is biased against white, male Republicans.
DeleteConsider the treatment of two male, white, Republican Americans who refused to testify before Congress. Many others have refused, and nothing happened to them. But, Bannon and Navarro actually served time.
You’re so full of shit, DiC.
DeleteDavid, your comment at 8:33 will be more effective when you provide examples of non-republicans who refused to testify.
DeleteWhen did Donald J Chickenshit testify, dickface?
DeleteDavid in Cal,
DeleteIn your opinion, why would anyone be biased against white supremacists?
Responding to your snark, @10:18. Historically Americans discriminated against women, blacks, Hispanics, Asians and Jews. Our society is making up for the past discrimination by now discriminating in favor of women, blacks and Hispanics. Somehow, though, Americans keep on discriminating against Asians and Jews.
DeleteDavid is right. If the average Jew or Asian was convicted of 34 felonies, they would probably find themselves behind bars.
DeleteIn what way(s) do Americans discriminate against Asians and Jews, David? Be specific.
Delete"Historically Americans discriminated against women, blacks, Hispanics, Asians and Jews."
DeleteWhere'd you hear that, David? Fox News, or did you read it in a Florida high school U.S. History textbook?
@3:13 college admissions for one.
Deletefuck you, dickhead in cal
DeleteDickhead, you fucking racist scumbag, you installed the Grand Wizard of the KKK to be Chief Justice of the Supreme Court, and his first order of business was to overturn the VRA, and you fucking come here whining about discrimination. Fuck you straight to hell with a rusty chain saw.
DeleteNow I know for sure David is a troll. There was a recent launch of a campaign ad with a white woman who couldn't be shown in the light because of all that reverse racism dontcha' know? Fucking idiots have absolutely nothing to run on besides their hate of the others.
Delete"TUESDAY: Could a Blue star ever do something wrong?"
ReplyDeleteWhy phrase the question like that? Somerby should be asking whether we know for a fact that Ilhan Omar has done anything that justifies the search of her home and confiscation of her phone and passport.
When Somerby refers to someone being persecuted by the DOJ as a "blue star" it is as if he wants to imply that other blue stars may be guilty of something too. Trump doesn't pussyfoot around like Somerby when he just blatantly calls Democrats criminals. Remember his "Lock her up" chants about Hillary? Suggesting that Democrats are committing crimes, from fraud to illegal immigration to marrying your brother is a right wing talking point that Somerby is repeating here in the guise of being open minded about right wing accusations. But the right tells so many lies that they cannot deserve the benefit of the doubt. Talarico got the flu and the right said he was secretly being treated in a mental institution. These are not people who deserve any credence at all, but Somerby suggests it is unfair, biased, for blues to suspect that Ilhan Omar never married her brother, not even at age 12.
This stuff is too ridiculous to spend time arguing about. Why does Somerby serve this up to us as a possibility? Because Republicans want to decrease votes for Omar and the election is next week. If he can tarnish Omar even a tiny bit, he has done his job.
Bob faults the timing of this investigation. If the race were close, I would agree. But, Omar is so far ahead that the odds in her favor are 94 to 6. Nothing Trump does could stop her from winning.
ReplyDeletehttps://www.predictionedge.com/elections/us-house/minnesota-district-5-race-winner-by-party/
So you admit Trump and his Doj is trying to prevent her re-election, pure and simple.
DeleteIs there an exception in the DOJ policy to not do this interference in politics within 60 days of election if the politician is way ahead in the polls, dickface?
DeleteDo you remember Eric swalwell? He was an up and coming blue “star”, favored to win the governor’s race in California. Then, he was forced to step down due to sexual assault allegations. I don’t see any “blues” defending him at this point. Blues tend to follow the facts. But Somerby implies today that we “blues” tribally defend our “stars” without knowing they did anything “wrong.”
ReplyDeleteMeanwhile Trump has relentlessly and publicly attacked Omar and called for her to be deported. Sounds vindictive to me.
To say nothing about the travesty they put Al Franken through.
DeleteThat was led by Kirsten Gillibrand, a crypto creep.
DeleteFranken hurt me as I always liked the guy, but his hand could not keep from roaming onto women's buttocks. Unlike Republicans who now openly celebrate and defend raping CHILDREN, we blues are not depraved, but moral; and sex pests like Franken, although wonderful in many aspects, gotta go.
DeleteDavid is annoying, but he’s not a criminal.
ReplyDeleteA RINO.
DeleteThat we know of.
Delete“ Federal officials identify 400 noncitizens registered to vote in Washington state: 'Tip of the iceberg'
ReplyDeleteActing US Attorney Neil Floyd said some identified individuals voted in multiple elections dating back to the late 1980s”
Hahahahaha. And roughly a week before an election we are supposed to believe a spokesman for a clown who tried to sabotage the last election? Maybe you MAGAts ought to sit this one out, serving penance for the fact that the dumbass you wholeheartedly support tried to overturn the last one. An acquaintance yesterday voiced his "I'll never watch another game!" displeasure with the WNBA because a team stays off the court for the National Anthem. I told him that the last time I was that triggered was when 140 Capitol Police were injured while the clown he voted into office watched on TV the riot that he instigated. So spare us your last minute bullshit. Your ilk apparently condones a hostile takeover of this country by a crime family.
DeleteSome have been voting for years? How many of the 400? Why doesn’t the government indict them? Where’s the rest of the ‘iceberg’?
DeleteDickhead in Cal: Keep in mind that when the fucking media refers to the fucking DOJ, the fucking media really is referring to fucking Trump’s fucking lawyer. You fucking racist treasonous bastard.
DeleteThey just came at a state saying 40,000 criminal voters, and after further review that number has increased down to fucking ZERO. These are fascists committed to ending democracy.
DeletePerhaps David will discuss whether Muslims face any discrimination by Americans.
ReplyDelete
