The New York Times tries to paraphrase Fox!

Can anyone here play this game?: Will Dominion Voting Systems win its lawsuit against Fox?

We can't answer that question. Reviewing a report in today's New York Times, a different question came to mind:

Can anyone here play this game?

This new report attempts to supplement prior reporting about Sidney Powell's unsupported claim—the unsupported, crackpot claim that Dominion's voting machines had been used to steal the 2020 election.

More specifically, the new report attempts to supplement prior reporting about what was being said on the air at Fox about this matter, as opposed to what Fox personnel were saying about Powell in private. The new report appears beneath this headline:

The new report supplements prior reporting on this topic through the use of eleven brief video clips. For that reason, it only appears online. 

That said, can anyone here play this game? The basic journalistic blocking and tackling in this new report is very poor. This includes the short accounts of what various Fox players said at various points in time—short accounts which appear beneath the relevant video clips.

In our view, the basic journalistic blocking and tackling is very poor. For today, we'll call attention to just one matter—to the report's account of what Tucker Carlson said on the air on November 19, 2020 as part of his nightly program.

As a matter of fairness, it should be said—Carlson wasn't endorsing Powell's claim on the air that night. Here's the first part of the New York Times' account of what he said:

THOMPSON ET AL (2/25/23): [On November 19], Mr. Carlson eviscerated Ms. Powell in a brutal 10-minute monologue, dissecting her claims as unreliable and unproven. He said the show had repeatedly asked her for evidence and, “when we kept pressing, she got angry and told us to stop contacting her.”

At that point, the Times report offers a 32-second clip from Carlson's ten-minute evisceration of Powell. That was a tiny sample of what Carlson had said—and the report then says this:

THOMPSON ET AL (continuing directly): In the same monologue, however, Mr. Carlson also gave some credence to Ms. Powell’s claims, saying that “we don’t dismiss anything anymore” and that he is “hopeful” she will come forward with evidence.

At that point, the Times offers a second, 27-second clip of what Carlson said that night.

Did Carlson actually "give some credence to Powell's claims" during his ten-minute monologue?  We'd call that a fairly large stretch. 

The Times does include a link to the full transcript and videotape of Carlson's "brutal 10-miniute monologue." Below, you see a substantial chunk of what Carlson said that night:

CARLSON (11/19/20): For more than a week, Powell has been all over conservative media with the following story: This election was stolen by a collection of international leftists who manipulated vote tabulating software in order to flip millions of votes from Donald Trump to Joe Biden. The other day on television, Powell said of Trump that when the fraud is finally uncovered, "I think we'll find he had at least 80 million votes." In other words, rigged software stole about seven million votes in this election. 

On Sunday night, "Tucker Carlson Tonight" texted her after watching one of her segments. What Powell was describing would amount to the single greatest crime in American history. Millions of votes stolen in a day, democracy destroyed, the end of our centuries-old system of self-government. Not a small thing.

Now, to be perfectly clear, we did not dismiss any of it. We don't dismiss anything anymore, particularly when it's related to technology. We've talked to too many Silicon Valley whistleblowers and we've seen too much after four years on the air.  We literally do UFO segments, not because we're crazy or even interested in the subject, but because there is evidence that UFOs are real and everyone lies about it.

There's evidence that a lot of things that responsible people dismiss out of hand as ridiculous are, in fact, real. The louder the Yale political science department and the staff of The Atlantic magazine scream "conspiracy theory," the more interested we tend to be. That's usually a sign you're over the target. A lot of people with impressive-sounding credentials in this country are frauds who have no idea what they're doing. They're children posing as authorities. And when they're caught, they lie and then they blame you for it. We see that every day. It's the central theme of our show and will continue to be.

That's a long way of saying we took Sidney Powell seriously, with no intention of fighting with her. We've always respected her work and we simply wanted to see the details. How could you not want to see them? So we invited Sidney Powell on the show. We would have given her the whole hour. We would have given her the entire week, actually, and listened quietly the whole time at rapt attention.

But she never sent us any evidence, despite a lot of polite requests. When we kept pressing, she got angry and told us to stop contacting her. When we checked with others around the Trump campaign, people in positions of authority, they also told us Powell had never given them any evidence to prove anything she claimed at the press conference.

Powell did say that electronic voting is dangerous, and she's right, but she never demonstrated that a single actual vote was moved illegitimately by software from one candidate to another. Not one.

We asked the Trump campaign attorney for proof of her bombshell claims. She gave us nothing.

In our view, the original reporting on this matter may have been somewhat misleading. Readers may have come away with the impression that Carlson was calling Powell crazy in private while endorsing her claims on the air.

In point of fact, Dominion is suing Fox News; it isn't suing Carlson. In the legal filings which have been released to date, most of its complaints concern the attacks on Dominion which were broadcast on programs hosted by Maria Bartiromo, Lou Dobbs and Jeannine Pirro. 

Carlson did blast Powell that night. Given the way the original reporting on this matter has been understood, we thought it was worth noting what Carlson actually said in that broadcast.

And no, Fox viewers didn't like it! The Times report continues as shown:

THOMPSON ET AL (continuing directly from above): Viewers expressed outrage at Mr. Carlson for challenging a prominent Trump ally. And Mr. Trump’s associates quickly jumped to her defense.

A link led to this real-time report in the Times about the outrage among Fox viewers.

We aren't mentioning the parts of today's report where we thought the blocking and tackling were least impressive. Nor are we attempting to tell you how well, or how poorly, Carlson performed in the months and years which followed with respect to claims that the election was stolen.

Our very strong assumption would be that he performed very poorly.

That said, Dominion's lawsuit only concerns claims which were made about Dominion. The lawsuit doesn't attempt to evaluate the work of major Fox players like Carlson in a more general sense.

In our view, Carlson's work is routinely disgraceful (though not always). That said, we were surprised to go back and read the transcript of that monologue. We thought that you might be surprised by it too.

Meanwhile, can anyone here play this game? We just watched the part of last night's program, The Beat, which focused on library books in Florida's schools.

Can anyone here play this game? After watching that report, we came up with a quick answer: 

No.

Reports on Fox are routinely a clown show. So was that effort last night. 

More and more and more and more, it seems to us that almost everything we read or see comes to us Straight Outta Script. Can a major nation function this way? Experts all seem to say no!

    1. Carlson is trying to shift the blame for Fox's reporting onto Sidney Powell. After some ritual Carlson denunciation (Somerby calls him horrible), Somerby lets him slide. The point of today's essay is to give a platform to Carlson's excuses. In that way, Somerby is helping to defend Carlson.

      It seems unlikely that Trump supporters will blame Carlson for bad reporting. They are unhappy that he is blaming Powell. But Carlson is moving on from Trump and doesn't seem to care about that. His main concern may be the lawsuit.

      Notice that Somerby has left off calling Carlson an excitable boy or damaged child, while he is under scrutiny for what Fox did to Dominion (which Somerby refuses to hold an opinion about). That's the clue that Somerby's goal today is to help Carlson, to build him up. What liberal would do that?

    7. Fox News has said that all of its staff who come on-site have been vaccinated but Tucker Carlson has been saying since last April that he didn't not get vaccinated. Someone is clearly lying.

      Then there is Carlson's refusal to tell anyone his vaccination status and there is this (Aug 6, 2021):

      One Twitter user pointed out that Carlson is giving a talk at MCC Feszt—an event that requires visitors to be vaccinated—in Esztergom, Hungary, on Aug. 7.

      “So @TuckerCarlson, who is a champion of vaccine and COVID-19 disinformation, who won’t disclose his own vaccination status, and who rules against vaccine mandates and ‘passports,’ is a featured speaker at a vaccinated-only event in Hungary,” another person tweeted."

      Carlson has been explicitly denying being vaccinated since April, 2022.

No, the point is that Carlson, for some reason, was coy about admitting whether he was vaccinated or not, but he went places on airplanes that had rules about being vaccinated, so people assumed he had the shot. He worked for Fox, which required its staff to be vaccinated and Fox said they were all vaccinated. You are suggesting that Carlson finagled his way around everyone's rules so that he could claim in April 2022 that he was unvaccinated. Carlson is a proven liar. Who would you believe? I don't think Hungary and the airlines would waive their rules to let an unvaccinated mask-scoffer like Carlson interact with Orban and a crowd of unwarned Hungarian citizens, risking all of their lives.   5. IANAL, but here are my comments FWTW. It's hard to win a suit against a public figure. One has to show actual malice. Was Dominion Voting Systems a "public figure"? I would guess so. Was there "actual malice"? Maybe. That's a technical legal term.

    When there's a basis for one's opinion, that's a defense against actual malice. That principle would seem to exonerate Fox News. They were relying on Sidney Powell.

    OTOH Sidney Powell may be in trouble. she doesn't seem to have any defense.

  6. Speaking as a citizen, I am concerned that Dominion was unwilling to make public all their software and procedures. So, they never proved to the public that there WEREN'T errors. I don't want votes counted by a system that cannot be fully audited. Going forward, I would rather see paper ballots used.

Although, I am less concerned about the computer and more concerned about the possibility that fraudulent votes were added.

      What particularly annoys me is that i haven't seen enough improvement in procedures going forward. Will we be having the same debate in 2024? I'm afraid we will.

      Dominion's software, one would suppose, is proprietary information. Why would they make it public when there are no rational questions which it could answer? (note all the voluminous detail Mao gave in his lame-brained comment).

      Dominion machines in Antrim County, Michigan accurately counted votes. The Michigan Secretary of State confirmed that a results reporting issue was due to user error. The Michigan County Clerks Association supported this finding. A Michigan Senate review of the 2020 election found no fraud, and went further by recommending investigation of those making money from false claims of fraud in the Antrim County election. A lawsuit alleging voter fraud in Antrim County based on a widely-debunked “forensic audit report” has been dismissed.

      FACT CHECK – Maricopa County, Arizona
      Dominion machines in Maricopa County, Arizona accurately counted votes. Maricopa County's hand count audit showed a 100% match with the counts from Dominion machines. A second round of equipment audits by federally accredited, independent Voting System Test Labs showed the equipment passed all tests. Maricopa County Board Chair Clint Hickman issued a statement affirming, “no evidence of fraud or misconduct” regarding the 2020 election. The Arizona Secretary of State published a report on issues with the Senate’s review of Maricopa County’s 2020 election results.   9. Newspapers all over the country are dropping the Dilbert comic strip because of racist remarks by its creator, Scott Adams. That is because such papers know that good, decent people care about racism, unlike Somerby and DeSantis. The point of an AP African American Studies course is to combat the ignorance that fuels racism, like that of Scott Adams. The point of DeSantis dropping it is to appease the racist Republican voters of FL and to "own the libs" at the cost of race relations (FL is 17% black). Good, decent people don't engage in racism, except for Somerby, who defends DeSantis and attacks Gates and the College Board.

    Somerby has no business calling anyone good and decent when he has no idea what that entails. I fully expect that Somerby will try to explain away what Scott Adams said.

  10. Quintessa Williams at The Root, says that "cancel culture" originated within black culture, to give redress via publicity to those who could not obtain it any other way. She describes how that then spread to mainstream media and ultimately has been co-opted by Republicans:

  14. I play a lot of duplicate bridge. In bridge, it is against the formal laws of bridge to call anyone else a cheater, even though there is flagrant cheating at both the higher and lower levels of the game. You cannot make such an accusation in public, at the table. What do you do if you suspect cheating? You tell a tournament director, they investigate quietly, behind the scenes (bringing in experts, using videos if available), there is an inquiry and someone may or may not be thrown out of the game.

    So, there is a right way to pursue accusations and a wrong way. The wrong way is nearly always to make a public accusation, but that is what Lee, Senior and Somerby all seem to be calling for.


    Cheating is excluded by the laws of bridge. Is there anything in our constitution that says a person with mental illness cannot be a public servant? These days, medication allows people to lead normal lives with any number of diagnoses. Why is there an assumption that if Trump were mentally ill, it would preclude his presidency (or anyone else's)?

    An accusation would lead to that question (in a just world), so perhaps people don't want to go THERE because it would make the whispering campaigns ineffective to point out to the public that mental illness is just another chronic condition and that mentally ill people are people with voting rights and the constitutional right to run for office if they want. I'll bet the supreme court would say that too.

    So where would that leave Somerby? Nowhere, in my opinion.

    3. @3:16, what do you think you know about either of them from that speculation? Corby was never a government scientist because anyone can put anything they want on a blog profile. It is more likely that Joe Bob Bill's occupation is correct. Are you aware that a major industry in Denver is government service? Here are the federal agencies that are there: US Dept of the Interior, Bureau of Land Management, U.S. Dept of Agriculture, National Park Service, US Army Corps of Engineers, US Environmental Protection Agency, US Geological Survey, Bureau of Reclamation, US Dept of the Treasury (and mint), US Dept of Transportation, US Dept of Public Safety, US Census Bureau, OSHA, NOAA, US Dept of Veterans Affairs, and don't get me started on the state agencies.

      Calling Corby a psycho isn't actually an argument against anything Corby has said. If found his description of the rules of duplicate bridge fascinating but Somerby probably would have fast forwarded through it. Did you know that Wilt Chamberlain used to play duplicate bridge? Maybe Corby should change his name to Wilt?

    4. I recollect that Corby had/has a Blogger profile which indicated that she is a woman and a psychologist or an instructor in psychology. She had been an insurance actuary a some point too.

      I remember Deadrat saying that he had seen the profile and remember he and Corby talking about these things. I never went to look for a profile.

      I also remember some posters calling her “Alba”, to which she took offense.

    5. Yes, people have been harrassing Corby for a while. You are confusing Corby with David in Cal, who said he was an insurance actuary. It would be reasonable to assume that Corby was a psychologist since she began commenting actively when Somerby started calling Trump mentally ill and using the word crazy, a word most clinical psychologists dislike. So, where does the "government scientist" come from? And if Corby can change his/her profile at will, what do you really know? Nothing. Deadrat said he was an attorney, but so does AC/MA and neither of them behaves or sounds like an attorney. So it is a matter of what you choose to believe, given that there is no way to verify anything at all here. Hell, Somerby says he is a Democrat and we all know that isn't true. I don't know what the Alba was about, except that no one likes to have a name foisted on them, as you keep trying to do.

      As to attorneys, I don’t remember Deadrat claiming to be one.

      My father was an attorney and I know a few other attorneys. I’m not sure how they’re supposed to “act like attorneys” on blogboards.
