What did Jack Smith find? Future Supreme Court Justice Aileen Cannon has hauled off and done it again.
That said, it seems that the DOJ still hopes to split the baby in question. Headline included, here's the start of the New York Times' breaking news report:
Justice Dept. to Hold Off Releasing Report on Trump Documents Case
Federal prosecutors said on Wednesday that they planned to hold off on releasing a portion of a report by the special counsel, Jack Smith, detailing his investigation into President-elect Donald J. Trump’s refusal to give back a trove of classified documents he took from the White House after leaving office.
But if the Justice Department can overcome an order blocking the rest of the report from coming out, it plans to release a separate volume concerning Mr. Smith’s other investigation into Mr. Trump’s efforts to overturn his loss in the 2020 election, prosecutors said.
The department’s decisions—laid out in a filing to a federal appeals court in Atlanta—brought a measure of clarity to what amounts to the final chapter of Mr. Smith’s work, which began more than two years ago and led to the first federal indictments of a former president in American history.
Overturning the election maybe, mishandling classified documents no? The "measure of clarity" laid out today falls a bit short of overwhelming.
For ourselves, we'd like to see the DOJ release the report about January 6. For the record, specialists seem to agree that there may not be much that's new in some such report. In this passage, Feuer and Savage explain why:
It is possible that even the release of the volume on the election interference charges may not contain much in the way of new or revelatory information. That is because in October, Mr. Smith filed an exhaustive 165-page brief laying out the evidence he planned to offer at trial.
That "exhaustive 165-page brief" was released on October 2. At the time, we the people were badly distracted as we tried to determine whether Haitian migrants were, or perhaps were not, eating a wide array of the state of Ohio's pets.
That, and other such issues! In the face of all that gorilla dust, we're not sure that Smith's specific findings were ever fully discussed
For ourselves, we remain curious about one question concerning the events of January 6, 2021. That question would be this:
On that morning, did President Trump know or believe that violence was going to take place at the Capitol?
Also this:
Had President Trump and/or members of TrumpWorld actively conspired with the organizations which had apparently planned to engage in such violence?
As far as we know, the January 6 committee never produced evidence of such connections. We're not clear concerning what Smith did or didn't find.
What did Trump know (or expect) and when did he know or expect it? We still aren't clear about that matter. Now that our pets are all safely indoors, we'd like to see a full account of what Smith actually found.

DeleteEveryone knows the protests were organic and Trump had nothing to do with any violence. That's why they shut down his Twitter account when he posted the video of him telling the protesters to go home. Pretending something else happened is why we got another Trump term.

ReplyDeleteThere is no evidence that Somerby watched the hearings or followed the investigation when it was ongoing. The point of releasing Jack Smith's report would be to provide the evidence to Somerby and the public that would connect Trump to the 1/6 crimes that perpetrators have already been convicted of committing.
Then it would no longer be possible for assholes like Somerby, who have made no effort to educate themselves about what really happened, to say that there is nothing connecting Trump to the insurrection.
The evidence presented on screen during the hearing was intended to support an impeachment vote. The court case prepared by Jack Smith is to convict Trump of participation in crimes. Our system should have let that case go forward so that Trump could be either exonerated or convicted, but instead it remains a mystery with Trump forever tarnished because he doesn't trust his own innocence and has fought any day in court.
Somerby too did what he could to undermine faith in the proceedings of that congressional committee. I don't expect that any amount of evidence connecting Trump to the events of 1/6 would satisfy Somerby, who is still calling Stormy Daniels names after Trump was convicted and is now a felon awaiting sentencing in his other trial.
Fight like hell to keep Smith from presenting his case, then claim there is no evidence of a connection between Trump and the insurrection. That's the level of honesty Somerby operates with.

The 1/6 committee witnesses included quite a few people who described hotel meetings and staff conversations and warnings to avoid the area, that all provided a roadmap for Smith's investigation. It is hard to say he has no evidence without releasing the report of his thorough investigation, which now cannot be presented at trial due to Trump's cronies on the Supreme Court granting him immunity.
ReplyDeleteThere were hints that not only did Trump know there would be violence, but others on his staff did too. Why else would his secret service protection detail refuse to let him go to the Capitol building himself, to the point of getting into a wrestling match when Trump tried to grab the steering wheel. What does Somerby think the gallows built on the Capitol steps was for? Clearly someone coordinated with the Oath Keepers to store their weapons outside the DC limits in easy reach so that they could bring them in once Trump declared martial law. The coordination with Kash Patel in the Pentagon to provide military support once the insurrection was in full swing shows pre-planning at Trump's level, given the recency of his appointment by Trump himself.
Somerby ignored the details of the testimony, so of course he knows nothing about what happened and can thus say he doesn't know of any connections. What an asshole Somerby is!

When Somerby suggests that he doesn't know what happened, he is advancing Trump's talking point from his press conference. That talking point is that no one knows what happened during the insurrection:

So, right at the point where we might actually get to hear the evidence, Trump is working overtime to suppress his report while also make ridiculous claims about what happened, placing the blame everywhere but on his own supporters.
And good old Somerby is right there with him, pushing the idea that we don't know anything about what happened and maybe Trump had nothing to do with it. I hope they are paying him well for his labors. It would be sad to lose one's soul for pennies.

All those kids who couldn't go to school because rabid Republicans believe whatever their leaders tell them, especially about migrants. Let's hear some more jokes about keeping those pets and the fucking kids indoors, Somerby!
Who delayed Smith's trial against Trump? Trump did. Who worked extra hard to gain immunity for Trump via the Supreme Court. Trump's buddies did that, to help Trump. Who delayed the release of the report that might show Trump had no connection to anything? Trump's lawyers again. Why wouldn't innocent Republicans want the truth about the insurrection to be known? Ask Trump.
We all want the report to leak. It is the only way the public gets access to the truth in an autocracy. But if it leaks instead of being released, Somerby will deny it is genuine. He may not believe it under any circumstances. Not knowing stuff is a virtue in Somerby's world.
Trump needn’t suppress Smith’s report. His supporters won’t care, and his opponents are already against him.
